FOODCRIPTION – Terms & Conditions

These Terms & Conditions ("Terms") govern your use of FOODCRIPTION’s services. By creating an account, placing an order, or otherwise using FOODCRIPTION PRIVATE LIMITED’s services, you agree to be bound by these Terms, along with our Privacy Policy.

Definitions

Account: refers to the unique, personal profile created by a Customer on FOODCRIPTION’s website or mobile application. The Customer is solely responsible for maintaining the confidentiality of login credentials and for all activities conducted through the Account.

Customer / User / You: refers to any individual or entity that creates an Account, places an order, subscribes to Membership or Services, participates in Corporate Programs, or otherwise uses FOODCRIPTION’s platform.

FOODCRIPTION / We / Us / Our: refers to FOODCRIPTION PRIVATE LIMITED and its authorized representatives. FOODCRIPTION coordinates with approved kitchen and brand partners to facilitate delivery of OneBox.

OneBox: the curated daily nourishment box delivered by FOODCRIPTION, which may include a core meal, beverage, nutraceuticals/supplements, dry snack, and fresh snack.

Services: collectively, the products, features, programs, and offerings made available by FOODCRIPTION.

Membership / Subscription: recurring service plan to access OneBox deliveries on a periodic basis, subject to these Terms and renewal/cancellation policies.

1. Acceptance of Terms

  • These Terms constitute a legally binding agreement between you and FOODCRIPTION PRIVATE LIMITED.
  • By creating an account, subscribing, or ordering a OneBox, you confirm that you have read, understood, and accepted these Terms.
  • FOODCRIPTION may update these Terms at any time; continued use implies acceptance.
  • You agree to comply with applicable laws when using our services.

2. Service Scope

  • FOODCRIPTION curates, coordinates, and delivers meals, snacks, beverages, and supplements via approved partners.
  • Nutrition information is for general wellness only; not medical or clinical advice.
  • Our role is facilitative: curation, quality standards, and delivery.

3. Eligibility & Information

  • You must be 18+ or have consent of a parent/guardian to register.
  • Provide accurate, current, and complete information.
  • Accounts with false/incomplete information may be suspended or terminated.

4. Membership and Subscription Model

  • FOODCRIPTION operates on a membership model.
  • Members may access discounted rates and benefits.
  • Memberships are non-transferable and valid for the registered individual.
  • Auto-renewal may apply; disable in Account settings before renewal to avoid charges.

5. Corporate Programs

  • Partnerships with organizations may offer subsidized meals.
  • Such programs are governed by separate agreements with the employer.
  • Employees remain subject to these Terms.

6. Orders, Refunds, Cancellations & Delivery

  • Orders must be placed within booking slots; otherwise may be rescheduled to next day.
  • No cancellations by the customer after placing an order.
  • Refunds may be issued at FOODCRIPTION’s sole discretion for incomplete/incorrect meals, spoiled food, or delivery failures attributable to us.
  • No refunds for reasons outside our control (e.g., unavailability, wrong address).
  • Services available only in specific areas; timelines are indicative and may vary.

7. Food Safety & Kitchen Responsibility

  • Meals are prepared by partnered, certified kitchens responsible for hygiene and compliance.
  • FOODCRIPTION does not directly cook or manufacture food.
  • Responsibility for contamination/spoilage/foodborne illness rests with the respective kitchen partner.
  • Products comply with FSSAI regulations; consult your doctor for specific medical conditions.

8. Allergen & Health Responsibility

  • Ingredient transparency is provided; review before consumption.
  • No guarantee of allergen-free meals.
  • Customers are responsible for ensuring suitability for their health needs.

9. Payments & Pricing

  • Prices are shown at order time and include applicable taxes unless specified.
  • Members may access discounted rates as per plan.
  • Accepted: UPI, cards, net banking, and wallets.
  • Payments processed by third-party gateways; bank/provider handles failed-charge refunds.
  • Promotions/rewards are non-transferable and may be changed or withdrawn at our discretion.
  • Dynamic pricing may apply.

10. Privacy & Data

  • We collect and process personal data per our Privacy Policy.
  • Data may be used for personalization, analytics, and aggregated insights.
  • In corporate programs, anonymized, aggregated reports may be shared with employers.
  • User feedback may be used for marketing with/without attribution.
  • You are responsible for activities under your account; report unauthorized use.
  • All IP (trademarks, menus, recipes, designs, software, content) belongs to FOODCRIPTION.
  • By using the Services, you consent to receive transactional/service communications (SMS, WhatsApp, push, calls, email). You may opt out of marketing communications separately.

11. Limitation of Liability

FOODCRIPTION shall not be liable for indirect, incidental, or consequential damages arising from use of the service. This includes missed meals, third-party delays, health reactions, or force majeure events. Maximum liability is limited to the value of the affected order.

12. Use of Services

  • No misuse (e.g., reselling meals, fraud, tampering with app/website).
  • Violations may result in suspension or termination without refund.

13. Termination of Account/Services

FOODCRIPTION may suspend or terminate your account if you:

  • Provide false information
  • Misuse offers or engage in fraudulent activity
  • Violate these Terms or applicable laws

Users may terminate their account at any time via our platform.

14. Amendments

FOODCRIPTION may modify these Terms; updates will be communicated via website, app, or email. Continued use constitutes acceptance.

15. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the jurisdiction where FOODCRIPTION is registered.
  • Disputes shall first be resolved amicably; unresolved disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996.
  • The seat of arbitration is Hyderabad; proceedings in English.
  • Courts in Hyderabad shall have exclusive jurisdiction.
  • Severability: if any provision is invalid/unenforceable, the remaining provisions continue in force.

17. Entire Agreement

These Terms, together with our Privacy Policy and referenced policies/guidelines, constitute the entire agreement between the Customer and FOODCRIPTION regarding use of our Services, superseding prior communications and understandings.
